- Customer: the natural or legal person who places an order on the Site.
- Products: the goods sold through the Site.
- Contract: the purchase contract concluded between Trendy Nails and the Customer for the sale of Products.
- Website: the website www.trendynails.it.
- Services: the additional services offered by the Site, such as customer support and product information.

Before placing an order, the Customer is required to carefully read these General Conditions of Sale and confirm his/her consent by selecting the box “I accept the General Conditions of Sale”. By sending the order, the Customer confirms that he/she has read and fully accepts the Conditions.

The purchase of Products takes place through the Site. The Customer must correctly fill out the order form, indicating the data required for shipping and payment. The order constitutes a purchase proposal by the Customer, which will be subject to confirmation by Trendy Nails. The purchase contract will be considered concluded only when the Customer receives an Order Confirmation via email.

Trendy Nails reserves the right to refuse to process an order in the event of:
- Inaccurate or incomplete data provided by the Customer.
- Failure to perform or suspected fraud.
- Insufficient availability of products.
- Other reasons which, at the discretion of Trendy Nails, make it inappropriate to process the order.
In this case, Trendy Nails will inform the Customer and, if already paid, will refund the amount paid within 14 days.

Product information, including images, descriptions and technical characteristics, is provided with the utmost care and commitment. However, differences between the images and the actual Products may occur, due to technical reasons or production variations. Any discrepancies will not give the Customer the right to raise any complaints.

- The prices of the Products are those shown on the Site at the time of purchase and include VAT. Shipping costs are calculated separately and must be added to the order total.
- Accepted payment methods include:
- PayPal (with credit or prepaid card).
- Scalapay (payment in 3 or 4 installments).
- Credit Card (via the secure 3D system).
- Cash on delivery (payment in cash on delivery).
- Bank Transfer (payment must be made after order confirmation).

Product availability is indicated on the Site. In the event of out of stock or supply problems, Trendy Nails will inform the Customer and, if a product is not available, will propose a replacement product. The Customer will have the option of accepting the replacement or receiving a refund.

- Shipping: Shipments are made via express courier (for example, GLS). Delivery is available throughout Italy, including the islands, San Marino and the Vatican City.
- Delivery times: Delivery times vary from 2 to 5 working days, but Trendy Nails undertakes to deliver the Products within 30 days of order confirmation.
- Absence of the recipient: If the recipient is absent, the courier will leave a notice of attempted delivery and will send a tracking code via SMS and/or email, with the option of scheduling a new delivery or choosing to have the package held at a courier branch.

The Customer has the right to withdraw from the Contract without any penalty and without specifying the reason within 14 days of delivery of the product.

To exercise the right of withdrawal, the Customer must send a written communication to info@trendynails.it or use the return form on the Site.
- The costs of returning the Products are borne by the Customer.
- Once the return has been received, Trendy Nails will refund the amount paid within 14 days, using the same payment method chosen by the Customer.

The products sold by Trendy Nails are covered by the legal guarantee of conformity pursuant to articles 128-135 of the Consumer Code. In the event of defects of conformity, the Customer has the right to repair or replacement of the product. If this is not possible, the Customer has the right to a total or partial refund.

Trendy Nails may offer free samples of its Products subject to availability and as part of special promotions. Samples are free of charge, but do not constitute a contractual obligation on the part of Trendy Nails. Requests for specific samples will not be accepted and the Customer is not entitled to compensation if the sample does not meet his/her expectations.

All intellectual property rights relating to the content of the Site, including text, images, logos, trademarks, videos, software and other copyrighted materials, are the exclusive property of Trendy Nails or its licensors. The Customer is not authorized to reproduce, distribute, modify, publish, display, transmit or otherwise use such materials without the prior written consent of Trendy Nails, except for the use of the Site for the purpose of purchasing Products.

Trendy Nails collects and processes the personal data of its customers in accordance with Regulation (EU) 2016/679 (GDPR). The data collected is used exclusively for processing orders, sending communications relating to the service and for managing customer relations.

The Customer has the right to access, rectify, delete or limit the processing of his/her personal data. For more information, consult the Privacy Policy available on the Site.

The Customer has the right to promote the extrajudicial resolution of disputes relating to the purchase contract through the tools provided by law, such as mediation pursuant to Legislative Decree 28/2010 and the conciliation procedures offered by the Chambers of Commerce. Furthermore, the Customer can use online dispute resolution platforms (ODR) to resolve the dispute quickly and easily.

Trendy Nails reserves the right to modify these Conditions at any time. The modifications will be published on the Site and will come into force from the date of publication. Purchases made before the modification will be governed by the Conditions accepted at the time of the order.

Trendy Nails assumes no liability for direct, indirect or consequential damages resulting from improper, negligent or non-compliant use of the products purchased. The products sold are intended exclusively for professional use as indicated in the product information. The buyer is required to always follow the instructions for use provided with the products and to comply with all applicable safety regulations.

In particular, Trendy Nails will not be held responsible for physical or material damage caused by improper use of the products (e.g. for use other than that intended or for use by unqualified persons). Furthermore, we are not responsible for damages resulting from force majeure events, such as courier disruptions or delays, strikes, supply problems, natural disasters, Internet interruptions, or other circumstances beyond our control.

The Customer is invited to verify the correct use of the products and to consult us for any doubts on the safe and compliant use of the products themselves.

If the Customer decides to create an account on our site to purchase products, he/she undertakes to keep his/her personal data updated and correct. The Customer is responsible for the security of his/her account, including password protection. In case of loss or suspected theft of the account credentials, the Customer is required to change them immediately and promptly notify Trendy Nails.

The Customer is also responsible for all activities carried out through his/her account, regardless of whether or not these have been authorized. Trendy Nails will not be held responsible for any damages resulting from improper or fraudulent use of the account by the Customer or unauthorized third parties.

If you believe your account has been compromised or if there is any suspicious activity, you must contact us promptly to resolve the situation.

The site www.trendynails.it is intended exclusively for lawful purposes. It is forbidden to use the site for fraudulent purposes, for the violation of intellectual property rights, or for any other illegal activity. It is forbidden to attempt to access in an unauthorized manner any part of the site, its systems or its information, as well as to carry out activities that could compromise the security of the site or its users.

The Customer undertakes not to use the site to:

•⁠ ⁠Make fraudulent purchases or purchases for purposes other than legitimate ones.
•⁠ ⁠Copy, reproduce, modify, distribute, publish, upload or transmit content that violates the intellectual property rights of Trendy Nails or third parties.
•⁠ ⁠Send malicious or unsolicited content (spam), computer viruses or other malicious software.
•⁠ ⁠Attempt to gain unauthorized access to any portion of the Site or related computer systems.

In the event of violation of these provisions, Trendy Nails reserves the right to suspend or block the Customer's access to the site, without prejudice to any legal action that may be taken.

Trendy Nails encourages its Customers to leave reviews on purchased products. Reviews must be truthful, constructive and compliant with the principles of respect and courtesy. Reviews must not contain offensive, defamatory, misleading or intellectual property rights violations.

Trendy Nails reserves the right to moderate and remove reviews that violate these guidelines, including content that incites hatred, violence, or contains inappropriate language. Reviews that do not comply with these guidelines may be removed from the site without notice.

The reviews left by Customers can be used by Trendy Nails for marketing, advertising and improvement purposes of the products and services offered, without this entailing any economic rights for the Customer, who consents to such use at the time of publication of the review.

These General Conditions of Sale are governed by Italian law. For any dispute relating to the interpretation, application and validity of these Conditions, the competent court will be that of the place of residence or domicile of the consumer, if the latter is located in Italian territory, in accordance with the provisions of the Consumer Code (Legislative Decree 206/2005).

In the event of a dispute with a consumer resident in another Member State of the European Union, the competent court will be that provided for by the applicable European regulations, without prejudice to the provisions of law that attribute an exclusive jurisdiction to the consumer.
